The legal regime of personal status is not always adapted to the current reality. It does not always reflect a way of perceiving nationality and does not always allow it to be used for the protection of a higher good and, in particular, of migrant minors.
This article will analyse two judgments handed down in Spain in relation to two cases of children born in transit who did not manage to acquire the nationality of either their country of origin or their receiving country
