  • This article examines how successive European rules have impacted immigration regulation. It analyzes the evolution of European policies and the influence of the various migration crises. On the other hand, it describes in detail the evolution of the criminal precepts under the European Directives, observing the impact of both the regulations and the migratory crises, being Spain a country that, together with other countries of Southern Europe, receives an important migratory impact. Finally, the situation of the irregular immigrant in internment, both penitentiary and non-penitentiary, and the state of human rights in such internment is examined.
