El artículo afronta la colaboración entre las comunidades científicas nacionales en el ámbito del Estado Constitucional, y, muy especialmente referidas al caso español respecto a Europa. Existe hoy una “sociedad abierta de los intérpretes de la Constitución” de alcance europeo, que alcanza a los tribunales constitucionales nacionales y al Tribunal de Justicia de la UE, que intercambian preceptos constitucionales, decisiones judiciales y construcciones doctrinales. Muchos son los temas para abordar desde esta “Constitución como cultura” y “como proceso abierto”: El estudio de “Europa”, las fuentes del Derecho, el federalismo y regionalismo (“Estado autonómico”), la justicia constitucional, los derechos fundamentales, el Derecho electoral o el Derecho parlamentario. En el artículo también se aborda si la Constitución española debiera contener un artículo expresamente dedicado a Europa; y, concluye, con un repaso a la literatura científica española, a través de sus distintos formatos, como las monografías, los manuales, las revistas jurídicas especializadas, los libros-homenaje y otros géneros, como los volúmenes recopilatorios de los trabajos de un mismo autor, las ediciones de textos normativos, el prólogo de las obras y las memorias de los tribunales, entre otras.
The article deals with the collaboration between national scientific communities in the field of the Constitutional State, and especially with the Spanish case in relation to Europe. Today there is an “open society of interpreters of the Constitution” of European scope, which reaches national constitutional courts and the Court of Justice of the EU, which exchange constitutional precepts, judicial decisions and doctrinal constructions. There are many topics to be addressed in this "Constitution as a culture" and “as an open process”: the study of “Europe”, the sources of law, federalism, and regionalism (“autonomous state”), constitutional justice, fundamental rights, electoral law and parliamentary law. The article also discusses whether the Spanish Constitution should contain an article expressly dedicated to Europe; and concludes with a review of Spanish scientific literature, through its different formats, such as monographs, manuals, specialised legal journals, tribute books and other genres, such as compilation volumes of works by the same author, editions of regulatory texts, prologues to works and court memoirs, among others.
