Resumen de Il “Trojan (non) di Stato”: una disciplina da completare

The Trojan Horse debate is still ongoing. The issues that require attention and intervention are many. They concern the hypothesis of its use in the context of wiretapping, which is explicitly regulated by law, as well as the other activities that can be carried out in the so-called “online search and surveillance”, a segment that is normatively untouched. The search for the right balance between investigative needs, the authenticity of results and the protection of fundamental rights in the use of such a powerful but also critical tool is inevitable and must lead to a codified solution in the near future.

Il dibattito sul captatore informatico è ancora in corso. Le questioni che richiedono attenzione e intervento sono molteplici. Esse riguardano sia l'ipotesi del suo uso nel contesto delle intercettazioni, espressamente disciplinato dal legislatore, sia le altre attività che possono essere compiute durante le c.d. “perquisizioni online”, segmento non toccato dal dettato normativo. La ricerca di un giusto equilibrio fra esigenze investigative, genuinità dei risultati e tutela dei diritti fondamentali, di fronte ad uno strumento tanto potente, quanto critico, è imprescindibile e deve condurre in tempi brevi ad una soluzione codificata.
