    Attraverso un’articolata ricostruzione della giurisprudenza interna e convenzionale, le sezioni unite della Corte di cassazione chiariscono che all’art. 578-bis c.p.p. deve riconoscersi natura di norma mista (processuale e sostanziale) e, dunque, che ad essa deve applicarsi il regime garantistico apprestato sia dall’art. 25, comma 2, Cost., sia dall’art. 7 Cedu e, in particolare, il divieto di retroattività.

    Through an articulated reconstruction of the domestic and conventional jurisprudence, the United Sections of the Court of Cassation clarify that Article 578-bis of the Code of Criminal Procedure must be recognised as a mixed rule (procedural and substantive) and, therefore, that the guarantee regime provided by Article 25(2) of the Italian Constitution and by Article 7 of the European Convention on Human Rights and, in particular, the prohibition of retroactivity, must be applied to it.
