La prestación por nacimiento y cuidado ante la muerte prenatal: su reconocimiento al padre o progenitor distinto de la madre biológica

    La muerte prenatal supone para la madre el derecho a un permiso laboral equivalente al que se le reconoce al tener un hijo vivo. Sin embargo, en el caso del progenitor distinto a la madre biológica, dicho derecho está en cuestión, habiendo sido negado por el Tribunal Supremo en su Sentencia de 5 de julio de 2022. En este trabajo se realiza una aproximación crítica a este problema, partiendo de una revisión histórica de la regulación positiva, para aportar argumentos en favor del tratamiento jurídico igualitario de la madre y el padre. En este mismo sentido apunta la doctrina judicial de los Tribunales Superiores de Justicia que se había venido pronunciado mayoritariamente a favor de la concesión del descanso paternal y, más aún, la reforma legislativa del Real Decreto-ley 6/2019, que unifica las antiguas prestaciones de maternidad y paternidad.

    Prenatal death entitles the mother to a period of leave equivalent to that granted in the case of having a living child. However, in the case of the parent other than the biological mother, this right is in question, having been denied by the Supreme Court in its ruling of 5 July 2022. This paper takes a critical approach to this problem, starting with a historical review of the positive regulation, to provide arguments in favour of the equal legal treatment of the mother and the father. In this sense, Regional Courts of Justice had been pronouncing in favour of granting paternal leave and, moreover, the legislative reform of Royal Decree-Law 6/2019, unifies the former maternity and paternity benefits, pointing in the same direction.
