  El trabajo presenta las principales ideas teóricas sobre el argumento de la intención del legislador. Para ello, describe la evolución del debate en torno a su significado y uso –con enfoque en el contexto europeo y estadounidense– y explica el actual contenido conceptual de este argumento. El trabajo concluye con sugerencias que permiten esclarecer la fuerza que deberían tener las intenciones legislativas en el ámbito de aplicación de las normas.

  The article presents the main theoretical ideas about the argument of the legislator’s intent, systematizing the evolution of the debate around its meaning and use – focusing on the European and North-American context – and explaining what is its current understanding. The paper is divided into an introduction, a section dealing with the theoretical perspectives on the role of the legislative intent in legal interpretation, a section dedicated to the situations in which it would be possible to depart from the legislative intention, and a conclusion, in which the most important ideas worked on in the text are resumed.
