    De un tiempo a esta parte, los pactos prematrimoniales en previsión de una crisis familiar vienen siendo admitidos por parte de nuestra jurisprudencia. Sin embargo, la falta de regulación conlleva que venga admitiéndose, asimismo, la libertad de forma respecto a ellos. Este trabajo pretende justificar que la presencia del notario en los pactos prematrimoniales habría de constituir un requisito "sine qua non" a efectos de evitar muchos de los problemas que este instrumento plantea en la actualidad y garantizar, así, la seguridad jurídica que se persigue cuando se hace uso de estos acuerdos pre-crisis.

    For some time now, prenuptiall agreements in anticipation of a family crisis have been admitted by our jurisprudence. However, the Iack of regulation means that the freedom of form ,regarding them has also been admitted. This paper aims to justify that the presence of the notary in pre-marriage proceedings should constitute a "sine qua non" requirement of the same in order to avoid many of the problems that this instrument currently currently poses and guarantee the legal certainty that is pursued when it is done, use of these pre-crisis pacts.
