The paper addresses a number of issues related to the regulation of the access to the preventive restructuring framework, highlighting the need for an interpretation of the new rules that does not create barriers to the possibility of making use of these framework; and this is also with a view to protecting the debtor from unfair behavior by creditors

Il contributo affronta alcune questioni legate alla disciplina dell'accesso agli strumenti alternativi di soluzione della crisi, ponendo in evidenza la necessità di un'interpretazione delle nuove norme che non crei ostacoli alla possibilità di avvalersi degli strumenti medesimi; e ciò anche nell’ottica di tutelare il debitore contro condotte abusive del creditore
