Resumen de El Derecho a la Resistencia ¿Se Puede Construir en Paz?

  El Derecho a la Resistencia (DR) como ficción jurídica y política, genera escenarios de complejo razonamiento, como derecho o como anti derecho. En Latinoamérica, se ha ido positivizando en algunos de sus ordenamientos jurídicos, sin embargo, su interpretación sigue siendo subjetiva y confusa. Su ejercicio ha adoptado manifestaciones violentas que han desnaturalizado su esencia. El DR como aspiración subjetiva imbricada de tutela legal, mientras se canalice por cauces pacíficos, puede representar crecimiento personal y empoderamiento del diálogo intercultural. Desde esta perspectiva, es necesario recurrir a los mecanismos de resistencia pacífica para propiciar prácticas democráticas válidas que tiendan a restaurar la plenitud del ejercicio de los derechos y la convivencia pacífica de la sociedad. Indispensablemente, debe superponerse la conciliación para tratar el conflicto en condiciones pacíficas. La construcción de espacios de resistencia debe consolidar el fortalecimiento de los sistemas democráticos y su reconocimiento como derecho, además de ser el eje de la justicia social en cualquier estado o gobierno.

  The Right to Resistance (DR) as legal and political fiction, generates scenarios of complex reasoning, as a right or as an anti-right. In Latin America, it has become positive in some of its legal systems, however, its interpretation remains subjective and confusing, its exercise has adopted violent manifestations that have denatured its essence. The DR as a subjective aspiration embedded in legal protection, while channeled through peaceful channels, can represent personal growth and empowerment of intercultural dialogue. From this perspective, it is necessary to resort to mechanisms of peaceful resistance to promote valid democratic practices that tend to restore the fullness of the exercise of rights and the peaceful coexistence of society. At the most, conciliation must be superimposed to deal with conflict in peaceful conditions. The construction of resistance spaces must consolidate the strengthening of democratic systems and their recognition as a right, to be the axis of social justice in any state or government.
