Resumen de Recientes novedades en materia de discapacidad y derecho de habitación.

En el presente trabajo estudiamos una medida cuya finalidad es beneficiar a un legitimario con discapacidad a través de un especial derecho de habitación para que sus necesidades habitacionales o de vivienda estén cubiertas a pesar del fallecimiento del familiar con el que residía. Este derecho se introdujo en nuestro Código Civil hace ya veinte años, con la Ley 41/2003, permitiendo su constitución a través de dos vías distintas:
de manera voluntaria pero también de origen legal. Analizamos la regulación y los requisitos que deben darse para la aplicación de esta figura, así como las modificaciones posteriores introducidas con la Ley 8/2021, y las diferentes cuestiones que resuelve este especial derecho de habitación, como tendremos ocasión de ver a continuación. De todas formas, y a pesar de los últimos cambios legislativos, la regulación actual de la figura sigue planteando ciertas dudas, como recogemos en las siguientes líneas.

: In this paper we study a measure whose purpose is to benefit a legitimary with a disability through a special housing right so that their housing or housing needs are covered despite the death of the family member with whom they were living. This special right was introduced into our Civil Code twenty years ago, with Law 41/2003, allowing its constitution through two different ways: voluntarily but also of legal origin. We analyze the legal regulation and the requirements that must be met for the application of this figure, as well as the subsequent modifications introduced with Law 8/2021, and the different issues that this special right to housing resolves, as we will have the opportunity to see below. In any case, and despite the latest legislative changes, the current regulation of the figure continues to raise certain doubts, as we collect in the following lines.
