En el presente comentario se aborda la pionera SJS núm. 2 de Bilbao núm. 503/2022 de 15 de diciembre (JUR 2023, 55364), sobre el reconocimiento de una incapacidad permanente en su grado absoluta como consecuencia del síndrome COVID persistente sufrido por un celador que se contagió del virus al inicio de la pandemia. Tras la negativa de la Seguridad Social a reconocerle la prestación, la sentencia estima la demanda ante el evidente cuadro clínico negativo que sufre el trabajador.

This comment addresses the SJS no. 2 of Bilbao no. 503/2022 of December 15 (JUR 2023, 55364), on the recognition of an absolute permanent invalidity benefit due to Long COVID syndrome suffered by an hospital attendant who got infected at the beginning of the pandemic. After the refusal of the Social Security entity to recognise the benefit, the judgment upholds the claim given the negative clinical symptoms suffered by the worker.
