El testamento notarial y algunos dilemas prácticos para lograr la adjudicación de herencia testada: a propósito de una resolución judicial

    Nuestro Código Civil desterró la figura del heredero forzoso e introdujo a los noveles herederos especialmente protegidos (institución que surge como una nueva limitación a la libertad de testar con el fin de reducir el número de personas favorecidas con la legítima), al tutelar a las personas que a la muerte del causante pierden su sostén monetario, precisamente por no encontrarse aptos para trabajar y depender económicamente de aquel; en tal sentido el ánimo del legislador está encaminado a no dejar sin protección a los mismos, destinándoles la mitad de la herencia, según el artículo 492 de nuestra Legislación Civil Sustantiva, sin embargo en ocasiones la voluntad del testador se ve limitada o demasiado retardada por otras cuestiones que dificultan su fin último, la adjudicación de los bienes.

    Our Civil Code banished the figure of the forced heir and introduced the specially protected heir novels (institution that emerges as a new limitation to the freedom to test in order to reduce the number of people favored with the legitimate one), by guarding people that upon the death of the deceased they lose their monetary support, precisely because they are not fit to work and depend economically on it; in this sense the mood of the legislator is aimed at not leaving them without protection, allocating half of the inheritance, according to article 492 of our Substantive Civil Legislation, however sometimes the testator's will is limited or too delayed by other issues that hinder its ultimate purpose, the adjudication of goods.
