La continua expansión de la legislación antiblanqueo y la deficiente redacción del art. 301 cphan determinado problemas interpretativos que aún hoy se encuentran necesitados de tratamiento. En concreto, existen dudas sobre el estándar probatorio del origen ilícito de los bienes objeto del blanqueo de capitales, así como sobre los criterios de corrección que pueden utilizarse para limitar la amplia literalidad del precepto. Son estos problemas los que pretendemos clarificar con este trabajo, cuestionando especialmente la exigencia de doble finalidad de ocultación o encubrimiento en todas las modalidades típicas de blanqueo.
The continuous expansion of anti-money laundering legislation and the deficient wording of art. 301 cp have given rise to interpretative problems that still need to be addressed today. Specifically, there are doubts about the standard of proof of the illicit origin of the assets involved in money laundering, as well as about the criteria of correctness that can be used to limit the broad wording of the precept. It is these problems that we intend to clarify with this paper, questioning especially the requirement of double purpose of concealment or concealment in all the typical forms of money laundering.
