Resumen de Una indemnización tarifada ¿es suficiente para reparar los daños del despido injustificado?

El objetivo principal de este artículo consiste en realizar un análisis crítico de la tarifa indemnizatoria prevista para los casos de despido sin causa en Argentina, a partir de preguntarnos por la causa jurídica en razón de la cual esta es debida y examinar algunas de sus funciones laterales. Luego, la realización de un breve estudio de casos, nos ayudará a demostrar la posibilidad de una mala utilización de este instituto por parte del empleador. Finalmente, decidimos relevar algunas propuestas de reforma al régimen actual, para concluir en la necesidad de una revisión del sistema legal vigente, tendiente a garantizar una consecuencia jurídica que verdaderamente proteja al trabajador y repare los daños de manera total, integral y suficiente.

The main objetive of this article consists of carrying out a critical analysis of compensation rate provided for cases of dismissal without cause in Argentina, starting from asking ourselves about the legal cause for which it is due and examining some of its lateral functions. Then carrying out a brief case study help us to demostrate the possibility of misuse of this institute by the employer. Finally we decided to highlight so reform proposals to the regime, to conclude on the need for e review of the current legal system, aimed at guaranteeing a legal consequence that truly protect the worker an repairs the demage in a total, comprehensive and sufficient manner.
