Cuando una sentencia determinaba el cambio de titularidad de un bien inmueble del demandado al demandante, condenaba, habitualmente, a otorgar escritura pública de compraventa, que es el documento que se inscribía en el Registro de la Propiedad para hacer constar el cambio de titularidad. La STS 14 enero 2015, en relación con un derecho de retracto, dice que no es necesario realizar ningún acto transmisivo del demandado al demandante. Por tanto, el cambio de titularidad se puede hacer constar en el Registro mediante la inscripción de la sentencia.

When a sentence determined the change of ownership of real estate from deffendant to plaintiff, habitually sentenced to grant public deed of sale, the document that was registered in the Land Registry to record the change of owner ship. The Supreme Court ruling 14 january 2015, in relation to a right of withdrawal, says that is not necessary to carry our any transmisisón act from deffendant to plaintiff. Therefore, the change of owner ship can be recorded in the Land Registry by entering the sentence.
