Resumen de OBSOLESCENCIA DE LA BIPARTICIÓN CIVIL LAW - COMMON LAW: GESTACIÓN DE NUEVOS MODELOS PROCESALES CIVILES ¿REALIDAD O UTOPÍA?

El objetivo principal de este artículo es presentar brevemente la historia, características y diferencias de los tradicionales modelos procesales: el common law y el civil law a fin de demostrar su obsolescencia y quiebre. Para estos efectos, se ha empleado el método funcional, propio del derecho comparado, en el entendido que se busca comparar el medio por el cual el common law y el civil law, resuelven sus conflictos de relevancia jurídica, esto es, el “proceso”, a través de la identificación sucinta de los rasgos esenciales de cada uno de ellos, diferenciándoles de elementos variables, mediante la constatación de normativa relevante (histórica y vigente) como de la verificación de las diversas posiciones dogmáticas básicas que han personificado a dichos modelos procesales. El resultado ha sido la comprobación de que en la actualidad los sistemas mixtos se asoman como una realidad más común de lo que pareciera.

The main objective of this article is to briefly present the history, characteristics and differences of the traditional procedural models: the common law and the civil law in order to demonstrate their obsolescence and bankruptcy. For these purposes, the functional method, characteristic of comparative law, has been used, in the understanding that it seeks to compare the means by which the common law and the civil law resolve their conflicts of legal relevance, that is, the "process" , through the succinct identification of the essential features of each of them, differentiating them from variable elements, through the verification of relevant regulations (historical and current) as well as the verification of the various basic dogmatic positions that have personified said procedural models. . The result has been the verification that currently mixed systems appear as a more common reality than it seems.
