Resumen de La giustizia climatica nell’Unione europea: il caso Carvalho e le prospettive future
The Carvalho case marks the starting point of a new field of judicial protection in the European Union, relating to the so-called climate justice. This new field is deeply embedded in the long-debated issue of the restrictive conditions imposed onnon-privileged applicants in accessing justice for challenging legal acts of the Union. In this sense, it once again raises the issue of the effective judicial protection with respect to the application of Article 263(4) TFEU, as interpreted in the light of the Plaumann formula. This issue is particularly relevant in this case as it is linked to the alleged violation of some fundamental rights recognized and protected by the Charter of Fundamental Rights of the European Union.
