  • The study examines the Judgment of the European Court of Justice of 20 April 2023 (Autorità Garante per la Concorrenza e il Mercato v Comune di Ginosa, Case C-348/22. The judgment confirmed the incompatibility with Article 12, paragraph 1 and 2, of directive 2006/123/EC of the Italian legislation which provides for the automatic extension of concessions for the occupation of maritime state property. The analysis also offers some ideas regarding the inevitable reform to which the Italian legislator must proceed.
