La gestación subrogada. Situación jurídicosocial en el ordenamiento español. A propósito de la STS 277/2022, 31 marzo 2022.

    El presente trabajo aspira a llevar a cabo un recorrido por la actual situación jurídica en la práctica de la gestación subrogada, comúnmente conocida como “vientre de alquiler” en España. En primer lugar, se analizará la posición del ordenamiento jurídico español respecto a esta realidad y los derechos que se ven envueltos en esta práctica. Posteriormente, se estudiará la evolución de la doctrina respecto al reconocimiento e inscripción de la gestación subrogada en España, comenzando por las primeras resoluciones de carácter administrativo, más laxas en su permisión, avanzando hasta la más reciente doctrina del Tribunal Supremo, que adopta una postura firme en contra de su reconocimiento.

    Todo ello, se realizará analizando los derechos que se ven afectados en esta práctica y como confronta la legislación y orden público actual. Finalmente, se establecerán conclusiones respecto a la práctica y reconocimiento de esta técnica en España.

    This paper aims to carry out a tour of the current legal situation in the practice of surrogate pregnancy, commonly known as “surrogate womb” in Spain. First, the position of the Spanish legal system regarding this reality and the rights involved in this practice will be analysed. Subsequently, the evolution of the doctrine regarding the recognition and registration of surrogate pregnancy in Spain will be studied, starting with the first administrative resolutions, laxer in their permission, advancing to the most recent doctrine of the Supreme Court, which takes a firm stand against its recognition. All this will be done by analysing the rights that are affected in this practice and how it confronts current legislation and public order. Finally, conclusions will be drawn regarding the practice and recognition of this technique in Spain.
