    La admisibilidad de los pactos prematrimoniales en previsión de una futura crisis matrimonial ha sido manifestada ya en varias ocasiones por el Tribunal Supremo. Sin embargo, son varias las cuestiones que se suscitan en relación con el contenido del mismo. En la sentencia aquí comentada, a colación de una renuncia anticipada de derechos, se presta especial atención a la necesidad de un consentimiento libre y consciente y al control de lesividad al que se ha de someter el pacto.

    The admissibility of prenuptial agreements in anticipation of a future matrimonial crisis has already been stated on several occasions by the Supreme Court. However, there are several questions that arise in relation to its content. In the sentence commented here, in reference to an early waiver of rights, special attention is paid to the need for free and conscious consent and to the control of harm to which the agreement must be subjected.
