Gestación subrogada y solidaridad familiar

    La nulidad del contrato de gestación subrogada en la legislación española está provocando un serio debate jurídico y social, ante la realización de esta vía de reproducción humana asistida por ciudadanos españoles que se desplazan a países con leyes que la permiten, y las posteriores solicitudes de reconocimiento de filiación en España y sus inscripciones en el Registro Civil español. Las diferentes posiciones mantenidas por el Registro Civil y el Tribunal Supremo hacen necesario un análisis profundo de la cuestión, que se muestra en este trabajo, desde la perspectiva de principios de orden público que fundamentan la regulación de esta materia, como el principio de la autonomía privada, el principio del interés superior del menor, y la protección de los derechos de la mujer gestante. Se profundiza en los efectos y consecuencias jurídicas en España de los contratos de gestación subrogada realizados por españoles en países permisivos, respecto del reconocimiento de filiación e inscripción en el Registro Civil de los menores nacidos por esta técnica, y se exponen diferentes sistemas de Derecho comparado. La novedad más actual sobre el tema, que se propone en el trabajo, es la visión de esta práctica desde la realización altruista de la gestación, introduciendo el principio de solidaridad familiar, que permite la posibilidad de gestación por mujeres del entorno familiar, que se ofrezcan de forma gratuita, a favor de personas de su familia interesadas en ser padres de esta forma. Es la nueva visión que se intenta introducir en las Propuestas de Ley que el Grupo Parlamentario Ciudadanos está presentando en el Congreso de los Diputados, aunque hasta ahora sin éxito. Recientemente, ha vuelto a proponer un proyecto de ley sobre gestación subrogada altruista, que se encuentra en tramitación.

    The nullity of the surrogacy contract in the Spanish legislation is causing a serious legal and social debate, in view of the performance of this method of assisted human reproduction by Spanish citizens who move to countries with laws that allow it and the subsequent requests for recognition of filiation in Spain, and its inscriptions in the Spanish Civil Register. The different positions held by the Civil Register and the Supreme Court make necessary an in-depth analysis of the issue, which is shown in this work, from the perspective of public order principles that basis the regulation of this matter, such as the principle of private autonomy, the principle of the child overriding interest, and the protection of the rights of surrogate women. Is discussed in more detail the effects and legal consequences in Spain of surrogacy contracts made by Spanish citizens in permissive countries, with respect to the recognition of filiation and registration in the Civil Register of child’s born by this technique, and different systems of comparative law are presented. The most current novelty on the subject, which is proposed in the work, is the vision of this practice from the altruistic realization of gestation, introducing the principle of family solidarity, which allows the possibility of gestation by women of the family environment, who offer themselves for free, in favor of family members interested in becoming parents in this way. This is the new vision that the Citizens Parliamentary Group is trying to introduce in the legislative proposals that it is presenting in the Congress of Deputies, although so far without success. Recently has reproposed a legislative proposal on altruistic surrogacy, which is being processed.
