    La regulación de la Náutica deportiva o de recreo en el Texto refundido de la Ley de Puertos del Estado y de la Marina Mercante y –en menor medida– en la Ley de Navegación Marítima, constituye una de las novedades más importantes del Ante proyecto de Ley de Reforma de aquellas disposiciones, inspirado –en este punto– por los objetivos de integrar esta materia en el ámbito general del Derecho Marítimo; de elevar el rango normativo de su regulación, haciéndolo ascender del plano del fuentes reglamentarias, al de la Ley parlamentaria formal y de corregir lagunas legales e incongruencias normativas preexistentes, a la par que desplegar una política de fomento del sector náutico deportivo, como subsector económico de importancia fundamental para España

    The regulation of sports or recreational boating in the Consolidated Text of the State Ports and Merchant Marine Law and –to a lesser extent– in the Maritime Navigation Law, constitutes one of the most important novelties of the Draft Law Reform of those provisions, inspired –in this point– by the objectives of integrating this matter in the general scope of Maritime Law; to raise the normative rank of its regulation, making it rise from the level of regulatory sources, to that of the formal parliamentary law and to correct legal gaps and pre-existing regulatory inconsistencies, while deploying a policy to promote the nautical sports sector, as an economic subsector of fundamental importance for Spain
