Resumen de La desviación del poder como límite a la discrecionalidad en la declaración de insubsistencia de funcionarios de libre nombramiento y remoción

  Pese a la confianza que requieren los cargos de libre nombramiento y remoción, la discrecionalidad en los actos administrativos que declaran su insubsistencia no implica facultades absolutas, sino que somete a la administración al mejoramiento del servicio, al interés general, a los requisitos legales de inscripción en la hoja de vida, a los parámetros jurisprudenciales de registro de motivos y al respeto por los derechos fundamentales del servidor público. Metodológicamente, se explicarán los elementos que acreditan la desviación del poder ante una arbitrariedad en la insubsistencia de este tipo de empleos, sus principales medios de prueba, y se justificará la acción de repetición.

  Despite the confidence required by the free appointment and removal position, the discretion in the administrative acts that declare the non-subsistence does not imply absolute powers, but rather submits the administration to the service improvement, to the common interest, to the legal requirements of the registration in the curriculum vitae, to the jurisprudential parameters of registration of reasons and to the respect for the fundamental rights of the public servant. Methodologically, the elements that prove the deviation of power before an arbitrariness in the non-subsistence of this type of jobs, its main means of proof and justification of the repetition action will be explained.
