La posibilidad conceptual y el argumento histórico en torno al estudio del precedente

    El presente artículo plantea la posibilidad de estudiar el concepto de precedente desde una perspectiva general, lo cual es viable desde la filosofía analítica del derecho, pero centra la atención en cómo esta empresa se respalda también con argumentos históricos. La tesis de fondo sostiene que –con independencia de las características particulares que cualquier sistema jurídico particular posea o de la familia cultural a la que pertenezca– es posible identificar ciertas propiedades necesarias que son constantes en el concepto de precedente donde se presente, intentando hacer evidentes tales propiedades. El análisis sugiere que es posible que hayamos construido teorías, evaluaciones, críticas y propuestas en torno al precedente sobre la base de una de tantas nociones locales que tenemos acerca de él, mientras su concepto sigue siendo oscuro. Tal afirmación evidencia dos necesidades: primero, que necesitamos esclarecer el concepto del precedente, entender su significado para estar en condiciones de evaluar, criticar o proponer adecuadamente cualquier cosa en torno a esta institución. Segundo, para llegar a dilucidar el concepto del precedente necesitamos eliminar las barreras y limitantes que usualmente se han impuesto a los estudios sobre este tema y abrirnos camino en otras direcciones al intentar un tipo de investigación que permita analizarlo desde un punto de vista general.

    This article raises the possibility of studying the concept of precedent from a general perspective, which is viable from the analytical philosophy of law, but focuses on how this company also supports historical arguments. The thesis maintains that – regardless of the particular characteristics that any particular legal system possesses or of the cultural family to which it belongs– it is possible to identify certain necessary properties that are constant in the concept of precedent where it is presented, trying to make evident such properties. The analysis suggests that we may have built theories, evaluations, critiques and proposals around the precedent based on one of the many local notions we have about him, while his concept remains obscure. This affirmation demonstrates two needs: first, that we need to clarify the concept of the precedent, understand its meaning in order to be able to evaluate, criticize or adequately propose anything around this institution. Second, in order to elucidate the concept of the precedent, we need to eliminate the barriers and limitations thathave usually been imposed on studies on this subject and to open the way in other directions by attempting a type of research that allows us to analyze it from a general point of view.
