Una de las herramientas usadas por los pueblos afrodescendientes de América Latina y el Caribe en la lucha por sus territorios ha sido el recurso a las instancias de justicia. Este artículo se centra en el papel que ha jugado específicamente la Corte Interamericana de Derechos Humanos (Corte IDH) en relación con las reivindicaciones territoriales de los pueblos afrodescendientes. Se trata de una investigación en curso sobre el uso de la justicia como herramienta de lucha de los pueblos afrodescendientes en América Latina y el Caribe, que se encuentra en una fase de sistematización de datos (sentencias, jurisprudencia, estudios relacionados) con elementos de análisis gradual que deberán siendo enriquecidos. De ahí la inclusión en extenso de los elementos de la documentación de la Corte IDH. Inicialmente, presentamos una visión panorámica sobre la situación de los territorios afrodescendientes. Luego, enunciamos un marco general sobre el Sistema Interamericano de Derechos humanos y los antecedentes de su implicación en casos relativos a grupos étnicos y sus territorios. Enseguida, se presenta una sistematización en orden cronológico sobre los casos que han llegado a la Corte IDH relacionados directamente con demandas de grupos afrodescendientes y reclamos territoriales. A partir de documentos de la Corte que hacen parte de los respectivos procesos, retomamos elementos de alegatos y sentencias que brindan una idea general para comprender el alcance de dichos casos. Finalmente, desarrollamos algunas reflexiones iniciales sobre las posibilidades y límites que han tenido las sentencias de la Corte IDH presentadas.

One of the tools used by Afro-descendant peoples in Latin America and the Caribbean in their fight for territorial rights has been resorting to the courts. This article focuses on the specific role played by the Inter-American Court of Human Rights in relation to the territorial claims of Afro-descendant peoples. It is an ongoing investigation on the use of justice as a tool in the struggle of Afro-descendant peoples in Latin America and the Caribbean, which is currently in a phase of data systematization (judgments, jurisprudence, related studies) with gradual elements of analysis that should be enriched. Hence, the extensive inclusion of documentation from the Inter-American Court. Initially, we present a panoramic view of the situation of Afro-descendant territories. Then, we provide a general framework of the Inter-American Human Rights System and its history of involvement in cases related to ethnic groups and their territories. Next, a chronological systematization is presented of the cases that have reached the Inter-American Court directly related to the demands of Afro-descendant groups and territorial claims. Based on documents from the Court that are part of the respective processes, we analyze elements of the arguments and sentences that provide a general idea to understand the scope of these cases. Finally, we offer some initial reflections on the possibilities and limitations presented by the sentences of the Inter-American Court.
