El derecho a la tutela judicial efectiva y el derecho a la igualdad de las personas con discapacidad en relación con la estabilidad laboral

    El objetivo fundamental de este trabajo es determinar cómo se vulnera el derecho a la igualdad de las personas con discapacidad frente a la estabilidad laboral y proponer los parámetros que se deben cumplir en el contexto del derecho a la tutela judicial efectiva para solucionar esta vulneración. Para ello, se realizó una revisión doctrinal de los derechos que intervienen en el estudio. También, se revisó la regulación jurídica ecuatoriana y los instrumentos internacionales de derechos humanos que inciden en el asunto a examinar. Igualmente, se desarrolló un estudio de caso en el que se refleja la vulneración de estos derechos y el pronunciamiento de una sentencia aditiva por parte de la Corte Constitucional para asegurar la protección especial a las personas con discapacidad como parte del grupo de atención prioritaria. Como hallazgo fundamental se identificó, a partir del contraste de la teoría y la jurisprudencia que, la tutela judicial efectiva opera como un mecanismo efectivo ante esta clase de violaciónde derechos, al igual que propone la aplicación de varios parámetros para garantizar su ejercicio efectivo en el Ecuador para proteger a estas personas y de esta manera materializar los mandatos constitucionales con respecto a ellas.

    The fundamental objective of this work is to determine how the right to equality of people with disabilities is violated in the face of job stability and to propose the parameters that must be met in the context of the right to effective judicial protection to solve this violation. For this, a doctrinal review of the rights involved in the study was carried out. Also, the Ecuadorian legal regulation andthe international human rights instruments that affect the matter to be examined were reviewed. Likewise, a case study was developed that reflects the violation of these rights and the pronouncement of an additional sentence by the Constitutional Court toensure special protection for people with disabilities as part of the priority attention group. As a fundamental finding, it was identified, based on the contrast of theory and jurisprudence, that effective judicial protection operates as an effective mechanism in the face of this kind of violation of rights, as well as proposing the application of several parameters to guarantee its effective exercise in Ecuador to protect these people and in this way materialize the constitutional mandates with respect to them
