Resumen de (In)efetividade do direito constitucional à educação básica: uma análise no contexto da pandemia do Covid-19

  The goal of this work is to analyze the constitutional law to basic education in Brazil. Therefore, this article aimed to briefly present the historical context that Law covered in the Brazilian Constitution, and to examine the role of the Judiciary Branch regarding the protection of educational rights, once it must guarantee those said rights, especially when they're being treated on an irregular manner due to the Granting Authority negligence -which sets up the judicialization process. This research used as its methodological instrument the technique of bibliographical and documental review, from the reading of National laws, in a qualitative approach. The research came in with the following results: education has been going through a structural crisis, which intensified during the Covid-19 pandemic, once poverty and marginalization grow back to back with how school evasion affects students. Research data displayed that during the pandemic period there was a high rate of school evasion, as e-learning emergency education activities presented several obstacles and deficiencies, such as the lack of access to the internet (which is the main tool in thismodality). Thus, it is observed that the constitutional right to basic education in Brazil was not effective during the Covid-19 pandemic.

  O objetivo deste artigo é analisar o direito constitucional à educação básica no Brasil, com isso, buscou-se apresentar brevemente o contexto histórico que o direito percorreu nas Constituições brasileiras e examinar a atuação do Poder Judiciário acerca da tutela dos direitos educacionais, o qual tem finalidade de garantir quando os direitos sociais educacionais estão sendo tratados irregularmente ou omissa por negligência do Poder Concedente, nesse passo, configura-se o processo de judicialização. A pesquisa adotou como instrumento metodológico a técnica de revisão bibliográfica e documental, a partir da leitura de diplomas nacionais, diante da abordagem qualitativa. Como resultado da pesquisa, tem-se que a educação passa por uma crise estrutural que se intensificou durante a pandemia de COVID-19, pois a pobreza e a marginalização crescem no mesmo passo que a exclusão escolar afeta os estudantes. Dados mostram que durante o período pandêmico houve um alto índice de evasão e exclusão escolar, as atividades de ensino emergencial não presencial apresentaram diversos obstáculos e deficiências, como exemplo a falta de acesso à internet, a principal ferramenta nesta modalidade. Sendo assim, observa-se a não efetividade do direito constitucional à educação básica no Brasil durante a pandemia de COVID-19.
