  e analiza en este artículo la resolución dictada por el Tribunal Constitucional del 20 de abril del 2023. En ella, se rechaza la demanda de amparo presentado por un tutor frente a la decisión judicial de vacunación de una persona que por su situación clínica no podía decidir por sí misma. Para el tribunal, la resolución judicial es proporcionada a la situación concreta de la persona afectada y la ley obliga en casos como este, a atender al superior interés para la vida y la salud del paciente.

  The resolution issued by the Constitutional Court of april 20, 2023 is analyzed in this article. In it, the amparo claim filed by a guardian against the judicial decision to vaccinate a person who, due to his clinical situation, could not decide by herself. For the court, the judicial resolution is proportionate to the specific situation of the affected person and the law requires in cases like this, to attend to the best interest for the life and health of the patient.
