¿Es posible la protección «intertemporal» de la libertad? La expansión del concepto de libertad en la sentencia del Tribunal Constitucional alemán en el caso Neubauer

    El Tribunal Constitucional alemán, en la sentencia del caso Neubauer c. Alemania sobre la inconstitucionalidad de la Ley de Protección del Clima (2019), sostiene que el derecho general a la libertad tiene un carácter «intertemporal». Esta sentencia vincula el principio de equidad intergeneracional recogidos en la ley fundamental con el derecho general a la libertad, asumiendo que este último debe garantizarse también en el futuro y, consecuentemente, se deben tomar medidas en la actualidad para hacerlo efectivo. Este artículo analiza la sentencia desde esta óptica y plantea la necesidad de reconfigurar, en la línea que lo ha hecho el Tribunal Constitucional, la noción de libertad ante la crisis ecológica presente.

    The German Constitutional Court, in the judgment of the case Neubauer v. Germany on the unconstitutionality of the Climate Protection Law (2019), upholds that the general right to freedom has an «intertemporal» character. This judgment links principles of intergenerational equity included in the Basic Law with the general right to freedom, assuming that the general right to freedom must also be guaranteed in the future and, consequently, measures must be taken today to make it effective. This article analyses the judgment from this perspective and raises the need to reconfigure, along the lines that the Constitutional Court has done, the notion of freedom in the face of the present ecological crisis.
