La eficacia de los acuerdos resultantes de la mediación internacional se regula de forma sustancialmente distinta en función de si se requiere un título público (modelo publicista de la UE) o si es suficiente un acuerdo meramente privado (modelo privatista de la UNCITRAL). Esta tensión entre modelos normativos afecta a la atribución de efectos de los acuerdos, a su reconocimiento y a su posible anulación. A día de hoy, este régimen jurídico se construye sobre respuestas parciales y fraccionadas, que han generado un panorama un tanto caótico.
The effectiveness of the agreements resulting from international mediation is regulated in a substantially different way depending on whether a public title is required (EU publicist model) or a merely private agreement is sufficient (privatist model of UNCITRAL). This tension between legal models affects the attribution of effects of the agreements, their recognition and their possible avoidance. Nowadays, this legal regime is built on partial and fractional responses, which have generated a somewhat chaotic scene.
