    La Sentencia del Tribunal Europeo de Derechos Humanos de 14 de junio de 2022, caso Cruz García c. España, y el Auto del Tribunal Superior de Justicia de Madrid de 11 de enero de 2023, estimatorio de un incidente nulidad de actuaciones interpuesto contra la sentencia del mismo órgano jurisdiccional de 2 de febrero de 2022, plantean nuevamente la cuestión relativa al deber de emplazamiento de los interesados en el proceso contencioso-administrativo cuando fueran susceptibles de identificación a partir de los libros del Registro de la Propiedad, así como la modalidad de la notificación cuando su número potencial fuera considerable.

    Both the European Court of Human Rights Judgment Cruz Garcia v Spain, no 2022/73, 14th June 2022, and the High Court of Madrid Order from 11th January 2023, which annuls its previous Judgement from 11 January 2022, again, open the debate on whether interested third parties, who can be identified in the Land Registry books, have to be summoned by courts into administrative proceedings and also the debate on the different means of notification when the potential number of interested third parties is high.
