As the 2014 tax reform, article 69-B of the Federal Tax Code (CFF) is added, which indicates that when the tax authority detects that a taxpayer has been issuing receipts without having the assets, personnel, infrastructure or material capacity, directly orin directly, to provide services or produce, commercialize or deliver the goods covered by such vouchers, the non-existence of the operations covered by such vouchers willbe presumed. The foregoing led to the detection by the tax authorities of a scheme consisting of the sale and purchase of invoices that covered simulated operations. Inthe last years, the Tax Administration Service (SAT) has been very scrupulous when conducting reviews of the taxpayers, verifying that all operations are duly supported with evidence that shows that they are real operations, the problem begins when the authority indicates that the taxpayer did not provide the appropriate documentation for the deductibility check, despite having submitted digital tax receipts. For many years, taxpayers verified their operations with invoices, receipts and sometimes with contracts; Therefore, a large number of companies have not bothered to support their activities, adding other types of evidence other than those indicated, therefore they have notmade changes in their internal controls and administrative policies; being surprised by the SAT, when they indicate that the evidence presented is not enough to prove their operations.
