Resumen de Preço de Transferência: uma tentativa de explicar o contencioso tributário brasileiro

  The article addresses the problem of high litigiousness in Brazil from the examination of the conflict involving transfer pricing. By examining the precedent formed in the Superior Court of Justice around the case AResp n° 511.736/SP, it is intended to demonstrate the scenario of high litigiousness and demonstrate the causes of the problem. The investigation adopts the inductive method starting from the particular case to produce answers to the litigious problem presented. The investigation is based on the economic literature and demonstrates that the cause of litigation can be explained by two factors: the agency problem (governance problem) and the path dependence.

  O artigo aborda o problema da alta litigiosidade do Brasil a partir do exame do conflito envolvendo preço de transferência. Ao examinar o precedente formado no Superior Tribunal de Justiça em torno do caso AResp n° 511.736/SP pretende-se demonstrar o cenário de alta litigiosidade e demonstrar as causas do problema. A investigação adota o método indutivo partindo do caso particular para produzir respostas para o problema da litigiosidade apresentado. A investigação se apoia na literatura económica e demonstra que a causa da litigiosidade pode ser explicada por dois fatores: o conflito de agencia (problema de governança) e a trajetória da dependência.
