Resumen de Libertad y dignidad: un enfoque desde la teoría de sistemas de Niklas Luhmann

Este trabajo aborda los problemas de la libertad y dignidad desde la discusión que desarrolló Luhmann sobre los derechos fundamentales y su función de restringir la tendencia expansiva del siste- ma político. La libertad no se entiende como norma natural que se impone al Estado como derecho, como tampoco se reduce a un valor subjetivo. Liber- tad y dignidad son hechos fácticos, que se configuran en el contexto de la liberalización de la persona y la diferenciación social. Ambas se condicionan mutua- mente y definen la integridad de la persona en su individualidad. En la teoría de Luhmann la libertad se circunscribe al ámbito social, mientras la dignidad al ámbito privado. Como instituciones sociales, los derechos fundamentales enfrentan los riesgos deri- vados de la inestabilidad del sistema político, entre ellos el totalitarismo. Finalmente, se reflexiona sobre la vulneración de las libertades en Venezuela y las posibilidades de restaurar un orden democrático y libre.

This paper addresses the problems of freedom and dignity from the discussion that Luhmann developed on fundamental rights and their function of restricting the expansive tendency of the political system. Freedom is not understood as a natural norm that is imposed on the State as a right, nor is it reduced to a sub- jective value. Freedom and dignity are factual facts, which are configured in the context of the liberalization of the person and social differenti- ation. Both condition each other and define the integrity of the person in their individuality. In Luhmann’s theory, freedom is confined to the social sphere, while dignity to the private sphere.
As social institutions, fundamental rights face the risks derived from the instability of the polit- ical system, including totalitarianism. Finally, it reflects on the violation of freedoms in Venezuela and the possibilities of restoring a democratic and free order.
