    El testamento revocado de forma tácita o expresa puede ser útil como elemento interpretativo del que rige la sucesión del causante, para descubrir su voluntad real. Sin embargo, su utilización como acto anterior, en el marco de la denominada prueba extrínseca, debe hacerse con cautela, para no poner en peligro el básico principio de que la voluntad del causante es ambulatoria hasta el final de sus días. Junto con el posible efecto interpretativo del testamento ya revocado, ineficaz en lo dispositivo, este trabajo analiza cómo debe valorarse el hecho de no revocar un testamento cuando han cambiado circunstancias esenciales que se tuvieron en cuenta al otorgarlo y si el silencio del testador ha de servir de base para averiguar su voluntad hipotética.

    The implicitly or expressly revoked will can be useful as an interpretive element of the one that governs the succession of the deceased, to discover his real intention. However, its use as a prior act, within the framework of the so-called extrinsic evidence, must be done with caution, so as not to put at risk the basic principle that the will of the deceased is ambulatory until the end of his days. In addition to the possible interpretative effect of the revoked will, ineffective in the device, this paper analyzes how the fact of not revoking a will should be valued when essential circumstances that were taken into consideration have changed and if the silence of the testator should serve as a basis to find out his hypothetical intention.
