Inmisiones materiales, efluvios y relaciones digitales de vecindad

    La relación de vecindad, en ámbito urbano o rural, puede generar molestias por la introducción reiterada de cosas o fluidos en un inmueble cercano. Si excede la normal tolerancia del vecino se denomina «inmisión». Aquí se analizan los caracteres que debe reunir para peticionar su cese.

    Al respecto, se advierte una evolución que avanza de lo material a lo inmaterial, y va desde la «inmisión material o directa» (introducción de hojas, agua etc.) hasta la «inmisión inmaterial, indirecta o efluvio» (humo olores, ruido, vibraciones etc.), y en nuestra época tecnológica, la inmisión de fluido eléctrico y radiaciones.

    Una tercera categoría es la «inmisión ideal, intelectual o moral». Por ejemplo si se expusiera a través de una ventana exhibiciones que ofendan al vecino, denigrando símbolos religiosos, maltratando a un animal, etc. Una situación especial la origina la inmisión de ondas de wifi. Este evento, en principio, no genera ninguna molestia, por lo que no configura una inmisión, pero bajo algunas circunstancias puede configurar una inmisión moral o intelectual si el titular de una red wifi agravia en forma anónima a un vecino a través del nombre que asigne a su propia red wifi.

    The relation of neighbours, in urban or rural areas, may generate inconveniences due to the reiterated introduction of things or fluids in a nearby property. If it exceeds the normal tolerance of the neighbour, it is called «nuisance». Here we analyse the characteristics they have to request its stop.

    In relation to this, an evolution is observed that advances from the material to the immaterial, which goes from «material or direct nuisance» (introduction of plant leaves, water, etc ) to «immaterial or indirect nuisance, or effluvia» (smoke, smells, noise, vibrations, etc.) and in our technological times, the nuisance of electricity and radiations.

    A third category is the «intellectual or moral nuisance». For example, when exposing through a window exhibitions that offend the neighbour, denigrating religious symbols, mistreating and animal, etc. A special situation is originated by the introduction of Wifi waves. This event, in principle, does not generate an inconvenience, and is not considered a nuisance, but under some circumstances can constitute intellectual or moral nuisance if the holder of a wifi network injures in an anonymous way a neighbour through the name assigned by his/her own wifi network.
