The Boundary between what is Right and what is Permissible. Considerations on the Sidelines of the National Bioethics Committee's Opinion on the Cospito Case This essay comments on the opinion provided by the National Bioethics Committee on some questions formulated by the Minister of Justice on prisoners'hunger striking. The questions are anomalous because they are visibly tailored on the human and legal story of Alfredo Cospito. Furthermore, the discussion should focus on the question of whether these are really ethical and not also legal questions: not only because, in the Cospito case, it's impossible to disentangle the alleged ethical issues from the political and legal-criminal ones, but also because of the feeling —shared also in some of the opinions that emerged within the Committee — that, in this case, ethics has been exploited for purposes that are outside its strict scope.

Il saggio commenta il parere fornito dal Comitato Nazionale per la Bioetica in merito ad alcuni quesiti formulati dal Ministro della Giustizia sullo sciopero della fame delle persone detenute. I quesiti sono anomali perché ritagliati visibilmente sulla vicenda umana e giuridica di Alfredo Cospito. C'è poi da discutere se davvero si tratti di quesiti etici e non anche giuridici: non solo perché, nel caso Cospito, è impossibile districare i supposti profili etici da quelli politici e da quelli giuridico-penali, ma per la sensazione — condivisa anche da alcune opinioni emerse in seno al Comitato — che in questo caso l'etica sia stata strumentalizzata per fini ad essa estranei.
