This research aims to alert about the deficiencies in the selection of Peruvian candidates to the organs of the Inter-American System of Human Rights, in light of the comparative experience and the debate generated to replace the magistrates with expired mandate of the Constitutional Court. At the same time, trying to show how the optimism deposited in transformative constitutionalism not only collides with the recent political convulsion that occurred in several South American countries, but also ignores the anti-democratic tradition in the summons of Latin American magistrates for the high courts.
