Regulación y uso de los decretos-leyes en las comunidades autónomas: la silenciosa invasión del ejecutivo al legislativo

    El presente artículo tiene dos ejes fundamentales. De un lado, presenta un estudio de la regulación del decreto-ley en las diez Comunidades Autónomas en las que el uso de este instrumento jurídico ha sido regulado. De otro lado, realiza un análisis comparado de su uso tanto en términos generales como atendiendo a determinados factores que pueden influir en la mayor o menor frecuencia de uso (el signo ideológico del Gobierno, la amplitud de la mayoría parlamentaria que sustenta al Gobierno, la existencia de una fractura etnolingüística, género de la persona que ocupa la Presidencia y, por supuesto, la gestión de la pandemia). Con ello se pretende poner en evidencia como el uso abusivo del decreto-ley supone, de facto, un desplazamiento de los parlamentos autonómicos en favor de los ejecutivos en el ejercicio de la función legislativa.

    This article has two fundamental axes. On the one hand, it presents a study of the regulation of the decree-law in the ten Autonomous Communities that have regulated this legal instrument. On the other hand, it carries out a comparative analysis of its use both in general terms and focusing oampn certain factors that may influence the greater or lesser frequency of use (the ideological sign of the Government, the breadth of the parliamentary majority that supports the Government, the existence of an ethnolinguistic fracture, the gender of the person who occupies the Presidency and, of course, the management of the pandemic). With this, it is intended to show how the abusive use of the Decree Law supposes, de facto, a displacement of the autonomous parliaments in favor of the executives in the exercise of the legislative function.
