The work focuses on the analysis of national legislation and the related international legal instruments protecting the right of access to food, taking into consideration the concept of "adequacy". The analysis highlights a positive process of constitutionalization of a fundamental right that does not belong to the Italian Constitutional tradition. Such a process actually works as a support of the existing legislation and shows a social interest towards a problem that cannot be addressed only from a commercial perspective and in compliance with the rules of economic distribution. Accordingly, the building of a system of legal rules and principles aimed to protect the right of access to food and to improve food diversity, even at local level, can be regarded as an expression of the fundamental principle of human dignity
