Resumen de Notas sobre a crise do desenvolvimento no estado contemporâneo

  This work studies the crisis in the development of the contemporary State and Democratic Law and the repercussions in the national and global realities. We observe that it is necessary to rethink the traditional institutes of positive law in the Theory of State in the light of Sociology and Economic Science. Legislation in disarray with modern economic issues can no longer regulate and guide the solution of the legal problems that present themselves in a fragmented society and before a process of complexization in the globalized world, with repercussions in the economy, in the social relations, in the productive systems and in the legal order. We conclude that the postwar contemporary democratic-capitalist state has evolved by pursuing welfare state claims, but has faced the problem of globalization with processes of complexity and fragmentation of society that have destabilized economic security, leading to juridification and the rise in inflation, which led to the decline of state interventionism. The crisis of the States and the increasing globalization of the economy have led to the need to reduce the laws. The democratic state, however, must guarantee development that ensures a social, economic and sustainable balance.

  Este trabalho estuda a crise no desenvolvimento do Estado contemporâneo e Democrático de Direito e as repercussões nas realidades nacional e global. Constata-se que é necessário repensar os institutos tradicionais do Direito positivo na Teoria do Estado, à luz da Sociologia e da Ciência Econômica. Uma legislação em descompasso com as questões econômicas modernas não consegue mais regular e orientar a solução dos problemas jurídicos que se apresentam em uma sociedade fragmentada e diante de um processo de complexização no mundo globalizado, com reflexos na economia, nas relações sociais, nos sistemas produtivos e no ordenamento jurídico. Conclui-se que o Estado contemporâneo democrático-capitalista do pós-guerra evoluiu ao perseguir garantias para o bemestar social [welfare state], mas enfrentou o problema da globalização com processos de complexidade e fragmentação da sociedade que desestabilizaram a segurança econômica, levando a juridificação e ao aumento da inflação, que determinaram a decadência do intervencionismo estatal. A crise dos Estados e a crescente globalização da economia levaram à necessidade do enxugamento das leis. O Estado Democrático, entretanto, deve garantir o desenvolvimento que assegure um equilíbrio social, econômico e sustentável.
