The theoretical framework regarding the origin of power and authority and whether or not both are synonymous is something that is very discussed and extremely important to begin the analysis of the emergence of the Law of abuse of authority and what it aims to combat. Based on this analysis, it was found that Law No. 4,898 / 65, which emerged at the height of the Brazilian military dictatorship, was not efective in combating abuse of authority in practice, requiring reformulation. Since then Law No. 13,869 / 2019 has emerged, which is the new Law on the abuse of authority in Brazil and which, because it arose in a social context totally diferent from the previous one, bringing articles that aim to protect several fundamental rights constitutionally provided for , which previously were not treated. In this perspective, the objective of the article is to analyze the relationship between the origin of power and authority and its relationship with the crime of abuse of authority, as well as the main changes instituted by the new Law. In the course of the work, it was identifed that abuse by of those who own it have always occurred, emphasizing the importance of control mechanisms in view of this fact. The research modality has a bibliographic character, based on the explanatory model.

O marco teórico a respeito da origem do poder e da autoridade e se ambos são ou não sinônimos é algo muito discutido e de extrema importância para iniciar a análise do surgimento da Lei de abuso de autoridade e o que ela objetiva combater. Partindo desta análise, verifcou-se que a Lei nº 4.898/65, que surgiu no auge da ditadura militar brasileira, não se mostrava efcaz no combate ao abuso de autoridade na prática, necessitando de uma reformulação. A partir de então surgiu a Lei nº 13.869/2019, que é a nova Lei sobre o abuso de autoridade no Brasil e que por ter surgido em um contexto social totalmente diferente da anterior, trazendo artigos que visam a proteção de vários direitos fundamentais constitucionalmente previstos, os quais, anteriormente, não eram tratados. Nesta perspectiva o objetivo do artigo é analisar a relação da origem do poder e da autoridade e, sua relação com o crime de abuso de autoridade, bem como as principais mudanças instituídas pela nova Lei. No decorrer do trabalho, foi identifcado que abusos por parte de quem o possuem ocorrem desde sempre, ressaltando a importância de mecanismos de controle perante este fato. A modalidade de pesquisa é de caráter bibliográfco, amparando-se no modelo explicativo.
