Resumen de O direito à cidade (inteligente): a governança participativa como condição de possibilidade para efetivação dos direitos humanos

  The article refers to the context of the redefinition ofthe Right to the City (Intelligent) and participatory governance asan unfolding of its democratic content. From this perspective,participatory governance is placed as a condition of possibility forthe realization of Human Rights. In this scenario, the problem thatthe article intends to answer is: is the emergence of participatorygovernance based on the democratic content of the Right to theSmart City a condition of possibility for the social efectivenessof Human Rights? The theoretical framework of the research willbe based on Gunther Teubner’s social constitutionalism and HenriLefebvre’s Right to the City. As a result of the research it was observed:the Right to the City of Lefebvre and the social constitutionalismproposed by Teubner, are conditions of possibility to guarantee theefectiveness of Human Rights based on participatory governance,which is placed as a decision-making process for the realization ofthe democratic content of the Right to the Smart City, but also as anefective instrument for the efectiveness of Human Rights basedon the right to work (Lefebvre).

  O artigo se refere ao contexto da ressignifcação do Direito à Cidade (Inteligente) e a governança participativa como desdobramento do seu conteúdo democrático. A partir dessa perspectiva, se coloca a governança participativa como condição de possibilidade para efetivação dos Direitos Humanos. Nesse cenário, o problema que o artigo pretende responder é: a emergência da governança participativa a partir do conteúdo democrático do Direito à Cidade Inteligente é condição de possibilidade para efcácia social dos Direitos Humanos? A matriz teórica da pesquisa terá como teoria de base o constitucionalismo social de Gunther Teubner e o Direito à Cidade de Henri Lefebvre. Como resultado da pesquisa se observou: o Direito à Cidade de Lefebvre e o constitucionalismo social proposto por Teubner, são condições de possibilidade para garantir a efcácia dos Direitos Humanos a partir da governança participativa, que se coloca como processo de tomada de decisão para concretização do conteúdo democrático do Direito à Cidade Inteligente, mas também, como instrumento eficaz de efetividade dos Direitos Humanos a partir do direito à obra (Lefebvre).
