    Este estudo possui como escopo analisar os fundamentos que sustentam as categorias das gerações futuras e da natureza a partir de traços problemáticos sobre sua proteção e do dever de cuidado no contexto da tutela jurídica. O método utilizado foi o hipotético dedutivo. Os direitos de natureza surgiram com protagonismo no século XXI, principalmente com a teoria biocêntrica que passou a enfrentar questões como tutela jurídica dos direitos da natureza, direito das futuras gerações ao meio ambiente adequado, bem como aspectos sobre os direitos ao meio ambiente e sua relação com os direitos humanos. Há elementos que presenciam na categoria do dever a responsabilidade de cuidado com as futuras gerações, bem como desafos de uma tutela jurídica da natureza para assegurar os direitos destas gerações. Evidenciam-se traços flosófico-jurídicos sobre a cultura das gerações presentes de usufruir os bens naturais em uma transição para uma constitucionalização dos Direitos da Natureza, implicando, vertiginosamente, em obrigações com a natureza e com as gerações futuras.

    This study aims to analyze the fundamentals that support the categories of future generations and nature based on problematic features about their protection and the duty of care in the context of legal protection. The hypothetical deductive method was used. Nature rights emerged with prominence in the 21st century, mainly with the biocentric theory that started to face issues such as legal protection of the rights of nature, the right of future generations to the proper environment, as well as aspects about the rights to the environment and their relationship with human rights. There are elements that witness in the category of duty the responsibility to care for future generations, as well as challenges for legal protection of nature to ensure the rights of these generations. Philosophical legal traits on the culture of the present generations are evident in enjoying natural assets in a transition to a constitutionalization of the Rights of Nature, implying, vertiginously, in obligations to nature and to future generations.
