The artiele proposes, in order to analize the «State», a journey from Philosophy of law towards History and Sociology. Using as a starting point the circunstances in which the «Nation» was created by the «State» in Portucale, the policital and juridical characterisation, of the «power-of-the-State» is studied, as is the evolution of the concepts of «sovereign» and «sovereignty», the existence of the «coercive apparattus» which confers law the essence of a class political will which, in each historical period, dominates and instrumentalises the «State».

L'article présente, par le biais de l'analyse de l'État, un cheminement de la Philosophie du Droit vers I'Histoire et la Sociologie.
L'auteur prend comme point de départ les circonstances dans lesquelles a eu lieu, dans la «Terra Portucalense», da création de la «Nation» par 1'«État».
On y étudie la caractérisation politico-juridique du pouvoir de l'État, l'évolution des concepts de «souverain» et de «souveraineté», le caracter constraignant du pouvoir politique et l'existence d'un «appareil coercitif» qui donne au Droit le caracter d'une volonté politique de classe qui, en chaque période historique, domine et utilise 1'«État».
