    La injuria como delito de género, lesiona la dignidad y autoestima de la ofendida que es pareja o expareja del agresor, generando un daño emocional. Para condenar a un acusado por este delito, no solo hay que probar los elementos típicos, sino que hay que hacerlo cumpliendo las especialidades penales y procesales que ha establecido el legislador para las distintas modalidades de este delito, lo que motiva el presente estudio, con el fin de valorar su efectividad para prevenir y castigar este tipo de ilícito, evitando una escalada de violencia.

    Insult as a gender crime, injures the dignity and self-esteem of the offended party who is the aggressor’s partner or ex-partner, causing emotional damage. In order to convict a defendant for this offence, not only must the typical elements be proven, but it must also be done in compliance with the criminal and procedural specialities established by the legislator for the different modalities of this offence, which motivates the present study, with the aim of evaluating its effectiveness in preventing and punishing this type of offence, avoiding an escalation of violence.
