Resumen de Search and Rescue of Migrants in the Mediterranean Sea Between Public Responsibility and Private Engagement: An International and EU Law Perspective

  • The paper provides a critical reappraisal of the international and EU legal framework for search and rescue operations in the light of the current mass migration by sea. Besides the most debated topics, like the concept of ‘place of safety’, the problem of disembarkation, the obligations of the coastal State responsible for the SAR region, the paper try to answer two main questions: whether SAR operations affect the application of the Dublin III Regulation and to what extent Flag States are responsible for search and rescue activities conducted by NGO ships.
