El deber de motivación de las resoluciones judiciales lesivas de derechos en el marco de la investigación tecnológica: comentario a la STJUE C-349/21 de 16 de febrero de 2023

    El deber de motivación de las resoluciones judiciales constituye una manifestación del derecho a un proceso equitativo consagrado en los arts. 6 CEDH y 47 CDFUE. El respeto a su contenido se hace todavía más evidente cuando a través de su dictado se pretende lesionar un derecho fundamental. Sin embargo, la diversidad de prácticas judiciales y disposiciones nacionales existentes en el contexto europeo pueden hacer que el nivel de protección de estos derechos fluctúe. En este artículo se comentará la reciente STJUE de 16 de febrero de 2023 («Bursa Romana de Marfuri», As. C-349/21) en la que se analiza el contenido que debe presentar una resolución que autoriza escuchas telefónicas. Una decisión que puede tener un importante efecto en el terreno de la cooperación judicial penal.

    The right of a fair trial enshrined in art. 6 ECHR and art. 47 European Charter of Fundamental Rights includes the obligation for courts to give sufficient reasons for their decisions. The extent to which this duty applies is particularly important in those cases affecting fundamental rights such as privacy. However, diversity in national judicial practices and legal provisions among European countries may lead to a fluctuation in the level of protection of fundamental rights. This paper addresses the recent judgment of the CJEU of 16 February 2023 (Case C-394/21, «Bursa Romana de Marfuri») regarding a preliminary ruling about the extension and the content of a judicial decision granting authorization to wiretapping in the context of criminal investigation. A decision which may have a relevant impact on judicial cooperation in criminal matters.
