The Supreme Court returns to deal with the nature of services relating to cryptocurrencies and qualifies themas financial services when they have an investment purpose in the way they are presented. The paper examines the issue of the nature of cryptocurrencies from the perspective of financial market law, also in light of the proposal for the new European Regulation on crypto-asset markets.

La Suprema Corte torna sul tema della natura delle attività aventi ad oggetto criptovalute, riconducendole fra le attività finanziarie quando assumano una causa di investimento per le loro modalità di presentazione. La nota esamina il tema della natura delle criptovalute nella prospettiva del diritto dei mercati finanziari, con alcune considerazioni anche alla luce della proposta del nuovo Regolamento europeo sui mercati delle criptoattività.
